Terms and Conditions

1. Services Provided

On-Way Logistics, Inc., doing business as Onway Logistics and Onway Auto Transport, is committed to providing the highest quality open and enclosed vehicle transportation services across the United States. Our services include pickup, transport, and delivery of passenger vehicles, light trucks, and other equipment as agreed in writing.

2. Customer Responsibilities

As a valued customer, it is crucial that you provide accurate vehicle and contact information. This ensures a smooth and efficient transportation process. The vehicle must be operable unless previously disclosed. All personal items must be removed from the vehicle unless explicitly permitted in writing. The customer is responsible for preparing the vehicle for transport (e.g., securing loose parts, disabling alarms, retracting antennas).

3. Scheduling & Delivery Windows

Pickup and delivery dates are estimates only. While On-Way Logistics strives to meet all scheduled timeframes, delays may occur due to weather, traffic, mechanical issues, or unforeseen circumstances. The Company is not liable for costs associated with such delays.

4. Insurance & Liability

On-Way Logistics carries comprehensive cargo insurance as required by the FMCSA. This insurance covers physical damage to the vehicle during transport due to carrier negligence, providing you with peace of mind.
Insurance does not cover:

  • Pre-existing damage
  • Personal belongings inside the vehicle
  • Acts of God (e.g., natural disasters)
  • Damage to the undercarriage, mechanical components, or suspension, unless directly caused by the carrier
You must note all damage on the Bill of Lading (BOL) at delivery.

5. Payment Terms

You must make payment as agreed—COD, prepay, or upon delivery.
Accepted payment methods include certified check, cash, or approved electronic payments.
Failure to pay may result in vehicle storage fees and enforcement of lien rights per California law.

6. Cancellation Policy

Cancellations made at least 24 hours before pickup may be eligible for a full or partial refund, less applicable administrative fees.
Cancellations within 24 hours of pickup may be subject to a dispatch or cancellation fee.

7. Pickup & Delivery Conditions

Pickup and delivery are door-to-door unless restricted by local ordinances or inaccessibility (e.g., narrow roads, low bridges).
In such cases, the driver will coordinate with the customer to arrange an alternative location nearby.
The customer or their authorized representative must be at pickup and delivery to inspect the vehicle and sign the required documentation.

8. Inspection & Damage Claims

You and the driver will perform a vehicle inspection at pickup and delivery.
You must note any damage at delivery on the Bill of Lading. Claims made after delivery without damage noted on the BOL may be denied.
You must submit all claims in writing within seven calendar days of delivery.

9. Governing Law

These Terms and Conditions shall be governed by and construed following the laws of the State of California. All legal actions shall be brought in the appropriate court in the County of Sacramento, California.

10. Modifications

On-Way Logistics reserves the right to modify or update these Terms and Conditions anytime. The most current version will be available on our website.
